How To Take Action Against Debt Collection Agency

Guest post by Anya Bennett

FDCPA law is initiated to address issues related to consumer harassment by unscrupulous creditors. Fair debt collection practice act is intended to protect debtors from unethical creditors who try to collect the debt by illegal means. This law has multiple provisions.

As for example, if a creditor threatens to sue a debtor, it will be considered illegal provided the creditors lacks any such real intention or is not legally empowered to take any such action. During this time a debtor will be fully within his rights to sue against the creditor for violating the law and claim compensation of minimum $1000. However, if you have enrolled with a debt settlement company, they can help you arrange a lawsuit against them.

If you are being tormented by the nagging creditors all these days, follow these instructions in order to spare yourself the horror of the collection agencies and creditors. Remember that being in offensive mode is always a great defense. They are not allowed to harass your life just because you owed them few bucks.

  1. Keep a list of all contacts and include all the dates and time of communication with all your creditors. Time of contact is important because creditors or collections agencies are prohibited to call you before 8am and after 9pm. Violation of the rule will invoke legal implication.
  1. Record all the telephonic conversation and produce it before your lawyer if necessary. Also keep other evidences like harassing voice mail and etc.
  1. Lodge a complaint against your creditor or collection agency at Federal Trade Commission or at their official website. You can also call at their toll free number 877-382-4357.
  1. You can make your colleague stand by your side as witness and ask him to make sworn statement before the court of law. If he can tell the copious details of date and time of the call, it will be an added advantage for you.
  1. Take some time to research all the provisions of the FDCPA law and get a printed copy of the official website of FTC. Now, make a list of all the violations made by the collection agency and note down the specific act referred to each violation. Then attach this copy to the mail or letter that you will send to your lawyer.

This way, you can really take a step forward and give them a lesson that they deserve.
